Are you a CUSTOMER or CLIENT?
As a buyer, when you work with a real estate licensee, do you
want to be treated as a customer or a client?
An agent owes certain duties to a client but has a different
obligation to a customer. A customer is a person who seeks to purchase real estate, but
has NOT established an agency relationship and is NOT represented by an agent. A customer
can expect the licensee to provide honest information but cannot expect the licensee to
act as an agent or to negotiate the best price in a purchase.
A real estate licensee is obligated by law to treat customers and
clients honestly, to disclose known material facts about the property, and to promptly
present all offers to the seller.
A client is a person who, by mutual written agreement,
establishes an agency relationship with and agrees to be represented by an agent in a real
estate transaction.
In addition to honesty, discloser of known material facts about
the property, prompt presentation of all offers, the client is entitled to fiduciary
client level services that include:
Loyalty
Act solely in the best interests of the client.
Obedience
Must follow all lawful instructions.
Disclosure
Disclose affirmatively all information concerning the transaction that might affect the
client's best interests.
Confidentiality
Any facts, personal information or discussions that should not be revealed to others, but
does not include responsibility of fairness and honesty in dealings to all parties.
Accountability in dealings
Promptly report to the client all money and property received and paid out; safeguard any
money or property held on behalf of the client
When I contract the services of Buyer Broker how do I (the Buyer)
benefit?
Your agent:

What is the cost for this service?
In most cases, there is absolutely no cost for this service if
the property is listed and the seller has agreed to pay a commission to your agent. If
your agent finds you a suitable property, with no previous commission agreement, then you
would, in that case, pay a commission, typically less than a listing commission because
there are no additional expenses such as marketing and advertising.
Sellers list their homes with real estate agents to
assure professional representation throughout the home selling process. As a buyer, you
deserve the same kind of service.
